The Judge Judith S. Kaye Solutions Not Suspensions Act (NY A.118/S.134) is common sense - moving us away from harmful exclusionary discipline and instead supporting educators and students with effective interventions.
In the 2023-2024 school year, more than 137,000 New York students lost nearly one million days of learning to suspensions. And, exclusion is disproportionately applied to students of color.
The Solutions Not Suspensions Act prohibits suspending students below fourth grade, except in cases involving weapons or serious bodily harm. It also puts an upper limit of 20 days on any suspension, far reduced from the current 180 days (full school year).
The bill directs schools to rely on mediation and community service before removing a student from class and requires a clear plan for continued education during time spent out of class so kids don’t fall behind on assignments or tests.
