AB 2499 is a significant leave expansion. California has created or expanded nine leaves in just the last four years.
AB 2499 expands a 12-week crime-related leave in several ways:
· Allows 12 weeks of leave for matters regardless of urgency or safety concerns, such as:
o Meeting with a financial planner
o Enrolling in financial benefits
o Arranging for modifications to technology, such as a phone or vehicle
o Searching for a residence for someone other than the employee
· Allows 12 weeks of leave for the above reasons and others where the victim is not the employee, but instead a friend, neighbor, or family member.
AB 2499 also requires small businesses to provide reasonable accommodations to an employee if their friend or family member has been a victim. Reasonable accommodations are often open ended and difficult for small employers to navigate or deny a request without risking litigation.
The bill applies to businesses with 25 or more employees, which are small businesses, and the breadth of this bill will be difficult for our businesses to comply with.
